Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Talk2UsNow (“Talk2UsNow”, “we”, “us”). They govern your access to and use of the Talk2UsNow website, dashboard, and related services (the “Service”). By creating an account or using the Service you agree to these Terms. If you use the Service for a business, you confirm you are authorised to accept these Terms on its behalf. Talk2UsNow is built by CalyxSol.

1. The service

Talk2UsNow lets a business collect customer ratings through a QR code. After rating their visit, every customer sees the same options, whatever rating they gave: leave a public review on a third-party platform such as Google, or send an optional private note to the business. The Service never decides who is invited to leave a public review based on their rating, and it does not offer rewards for reviews or feedback. Features and pricing may change as the product evolves.

Talk2UsNow is a software platform that provides tools to help you collect and manage customer feedback. We do not guarantee any particular number of reviews, ratings, leads, revenue, or other business outcomes. Third-party platforms such as Google are independent services; their availability, policies, and decisions are outside our control, and we do not act for or represent them.

2. Eligibility & your account

  • You must be at least 18 and able to form a binding contract.
  • Give accurate account information and keep it current.
  • You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly of any unauthorised use.
  • Invited team members act under the account owner’s business and permissions.

3. Free trial

New accounts may start with a 7-day free trial. No card is required to begin. If you do not subscribe, the trial simply ends and your review page goes offline.

4. Subscription, billing & taxes

  • After any trial, the Service is offered on a subscription (currently $5 per location per month or $49 per location per year, or as shown at checkout).
  • Billing is handled by our Merchant of Record, Lemon Squeezy, which collects payment and may add applicable taxes at checkout.
  • Talk2UsNow receives billing and account metadata such as your subscription status and renewal state, but not your card number.
  • Subscriptions renew automatically until cancelled. If a payment fails, your account may enter a past-due state and, if unresolved, be suspended (your review page goes offline).
  • You can cancel at any time. Refunds are governed by our Refund Policy.

5. Acceptable use

You agree that you will not:

  • create fake feedback, fake reviews, or otherwise attempt to manipulate ratings;
  • offer discounts, gifts, or other rewards in exchange for reviews or ratings;
  • ask only satisfied customers for public reviews, or otherwise suppress or discourage genuine reviews in a way any third-party platform (including Google) prohibits. Every customer must always be free to leave a public review;
  • use the Service for anything unlawful, abusive, misleading, or infringing;
  • probe, breach, or disrupt the Service, or access data that is not yours.

You are responsible for complying with the review and content policies of any third-party platform you route customers to.

6. Your customers’ data & our roles

Depending on the context, Talk2UsNow acts as a controller or a processor of personal data, as described in our Privacy Policy. For customer feedback submitted through your account, you (the business) are the controller and determine the purposes of processing, and Talk2UsNow acts as a processor, processing that feedback only on your documented instructions and applicable law. For account, billing, security, and service-operation data, Talk2UsNow acts as the controller. Where Talk2UsNow processes personal data on your behalf, the Data Processing Agreement forms part of these Terms.

As the controller of customer feedback, you are responsible for:

  • having a lawful basis to collect and use customer information, and providing any notices and obtaining any consents required by applicable law;
  • collecting only what you need, and not requesting sensitive information (including health or medical information and other sensitive categories of personal data) through the feedback form unless you have appropriate safeguards;
  • responding to data-subject requests where you are the controller. Talk2UsNow will provide reasonable assistance as described in the Data Processing Agreement.

7. Intellectual property & your data

The Service, including its software, design, and content (other than your data), belongs to Talk2UsNow. We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing.

You retain your rights in your business data and the content submitted through the Service. Nothing in these Terms transfers ownership of your business data or customer-submitted content to Talk2UsNow. You grant Talk2UsNow the limited rights necessary to host, store, transmit, process, display, and secure that data solely as necessary to provide, maintain, secure, and support the Service, and as otherwise permitted by the Data Processing Agreement.

8. Third-party services & sub-processors

The Service relies on third parties, including Supabase (database and authentication), Vercel (hosting), Resend (email delivery), Lemon Squeezy (billing), and Google (public reviews). Your use of those platforms is subject to their own terms. Where these providers process personal data on your behalf, they act as sub-processors under the Data Processing Agreement. We are not responsible for third-party services, or for what customers post on platforms such as Google.

9. Availability & disclaimer

We work to keep the Service available and reliable, but it is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to that, and to the maximum extent permitted by law, Talk2UsNow will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim is limited to the fees you paid us in the three months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold Talk2UsNow harmless from third-party claims arising out of your breach of these Terms, your unlawful use of the Service, your business data or customer content, or your infringement of a third party’s rights.

12. Suspension, termination & your data

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to the Service.

After your account ends, you can export your data from the dashboard for 30 days. After that period, Talk2UsNow may delete your data, except where retention is required by law or reasonably necessary for security, fraud prevention, or dispute resolution. Where Talk2UsNow processes personal data on your behalf, deletion or return of that data follows the Data Processing Agreement.

13. Changes

We may update the Service and these Terms. For material changes we will take reasonable steps to notify you and will revise the “last updated” date above. Continued use after a change means you accept it.

14. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules. The courts of Pakistan will have exclusive jurisdiction, unless applicable local law grants you rights or a forum in your own jurisdiction that cannot be waived.
